You must read and agree with the terms of this agreement and the Information Management Policy
(Privacy Policy) set forth hereafter. If you do not agree with the terms and conditions of this agreement
set forth below, do not use or access the website's services.
You are over eighteen (18) years of age.
Pool Service Center purchases high quality swimming pools directly from pool manufacturers. All products
are new and not reconditioned, and carry a limited warranty as set forth below.
Upon receipt of appropriate credit information, Pool Service Center will ship to the address given
within 5 days.
All prices are FOB shipping point. Method and route of shipment are at our discretion, unless the Purchaser
supplies explicit instructions. Purchaser shall bear the risk of loss, deterioration, or damage, from the
time goods leave our premises. We shall not be liable for loss or damage of any kind resulting from delay
or inability to deliver on account of fire, labor troubles, accident, acts of civil or military authorities,
or from any other cause beyond our control
Purchaser shall inspect the goods immediately upon their arrival. We guarantee to replace, or at our option,
repair any goods which are found defective in material or workmanship within thirty (30) days after the
receipt of such goods. Our obligation with respect to such goods shall be limited to replacement or repair
FOB shipping point, and in no event shall we be liable for consequential or special damages, or for
transportation, installation, adjustment or other expenses which may arise in connection with such goods.
Purchaser assumes all risk and liability for the results obtained from its examination and tests of any
goods delivered hereunder and for the results obtained in its installation processes by the use of any
goods delivered hereunder or by the use of such goods in combination with other substances. Purchaser's
failure to give written notice of any claim with respect to the quality of workmanship of the goods within
thirty (30) days after the receipt of such goods shall constitute Purchaser's unqualified acceptance of such
goods and waiver by Purchaser of all claims with respect thereto, including any right to revoke acceptance.
Other than the limited repair or replacement warranty set forth above, there are
NO EXPRESS WARRANTIES AND NO IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE. Under no circumstance shall we be liable for consequential or
special damages, or other expenses which may arise in connection with the goods.
Our acceptance of your Order is expressly made conditional on your assent to the conditions stated herein.
The conditions stated herein shall take precedence over any other conditions and terms, and no contrary
additional, or different provisions, terms or conditions shall be binding on us unless accepted by us
in writing. Your acceptance of the goods delivered shall constitute your assent to the conditions and terms
herein and shall constitute your agreement that such terms and conditions shall constitute the sole terms and
conditions of the Contract with us.
In the event it becomes necessary for Seller to file suit and to collect the price herein, Purchaser agrees
to pay all expenses whatsoever, including attorney fees that Seller may incur.
All content included on this site, such as text, graphics, logos, button icons, images, audio clips,
digital downloads, data compilations and software is our property or our suppliers and protected by
United States and international copyright laws. The compilation of all content on this site is our
exclusive property and likewise protected.
We grant you a limited license to access and make personal use of this site and not to download or modify it,
except with express written consent.
We respect the intellectual property of others. If you believe that your work has been copied, please
contact us.
The validity, construction and performance of this Contract shall be governed by the laws of the state of
Tennessee, and in the event of litigation, the venue shall lie in Knox County, Tennessee.
Any legal controversy or claim shall be settled by binding arbitration under the American Arbitration
Association and held in Knox County, Tennessee.
Circumstances or the laws may change; therefore, we may amend this agreement and this website's information
management policy (privacy policy), which you have read, from time to time by posting amended terms and
conditions on this website of which you agree to be bound.
Standard restocking fee of 25% applies to all returned items.
We reserve the right to make corrections to prices listed on this website, at any point in time. Prices
listed on the website are not an offer under contract law.
